Terms and Conditions Roos Illustraties
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Entrepreneur: The natural or legal person who offers products and/or services remotely to customers.
- Customer: The natural person who does not act in the exercise of a profession or business and enters into a distance contract with Roos Illustraties.
- Distance contract: A contract in which, within the framework of a system organized by Roos Illustraties for remote sales of products and/or services, one or more remote communication techniques are exclusively used up to the conclusion of the contract.

Article 3 – Applicability of General Terms and Conditions
- These general terms and conditions apply to every offer (quotes, proposals, work, orders, agreements, and deliveries of services and/or products) from Roos Illustraties and to every distance contract concluded between Roos Illustraties and the customer.
- Before the distance contract is concluded, the text of these general terms and conditions will be made available to the customer at the end of the order process. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be inspected at Roos Illustraties and that they will be sent to the customer free of charge upon request.
- If specific product or service conditions apply in addition to these general terms and conditions, the second paragraph (Article 3) applies accordingly. In the event of conflicting general terms and conditions, the provision most favorable to the customer prevails.
- Roos Illustraties and the customer may deviate from these general terms and conditions only if they have explicitly agreed to do so in writing.
- Additional or deviating provisions from these general terms and conditions may not be disadvantageous to the customer and must be recorded in writing in such a way that they can be stored accessibly by the customer on a durable medium.
Article 4 – The Offer
- If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
- The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to enable the customer to assess the offer properly. If Roos Illustraties uses images, these will be a true representation of the offered products and/or services. Obvious mistakes or errors in the offer do not bind Roos Illustraties.
- Every offer includes information making it clear to the customer what rights and obligations are associated with accepting the offer, particularly concerning:
- The price, including taxes;
- Any delivery costs;
- The method by which the contract will be concluded and the necessary steps for this;
- Whether or not the right of withdrawal applies;
- The method of payment, delivery, or execution of the contract;
- The period for accepting the offer or the deadline for maintaining the price;
- The conditions for remote communication costs if they are calculated differently from the standard rate;
- If the contract is archived after conclusion, how the customer can access it;
- The manner in which the customer, before concluding the contract, can verify the data he provided and correct them if necessary;
- Any available languages for the contract besides Dutch;
- The codes of conduct to which Roos Illustraties is subject and how the customer can consult these electronically;
- The minimum duration of the distance contract if it involves continuous or periodic delivery of products or services.
Article 5 – Offers, Quotes, and Acceptance
- Offers and quotes from Roos Illustraties are non-binding unless explicitly stated otherwise.
- An offer or quote is valid for a maximum of fourteen days unless a different acceptance period is specified.
- If the customer does not accept an offer or quote within the stated period, the offer or quote expires.
- Offers and quotes do not apply to repeat orders unless explicitly agreed upon in writing.
- If a customer accepts a non-binding offer or quote, Roos Illustraties reserves the right to withdraw the offer or quote within three days of acceptance without obligation.
- Oral acceptance by the customer binds Roos Illustraties only after written or electronic confirmation.
Article 6 – The Contract
- The contract is concluded at the moment the customer accepts the offer and fulfills the stipulated conditions, subject to the provisions of paragraph 5.
- If the customer has accepted the offer electronically, Roos Illustraties will confirm receipt of acceptance electronically without delay. The customer may dissolve the contract as long as this confirmation has not been received.
- If the contract is concluded electronically, Roos Illustraties will take appropriate technical and organizational security measures for the electronic data transfer and ensure a secure web environment. If the customer can pay electronically, Roos Illustraties will implement appropriate security measures.
- Within legal frameworks, Roos Illustraties may verify whether the customer can meet payment obligations and other relevant factors for responsibly entering into a distance contract. If Roos Illustraties has valid reasons based on this investigation, it is entitled to refuse an order or application or to impose special conditions on the execution.
- Roos Illustraties will provide the customer with the following information in writing or in a manner accessible for durable storage:
a. The address of Roos Illustraties for customer complaints;
b. The conditions and method for exercising the right of withdrawal or a clear statement if the right of withdrawal is excluded;
c. Information about after-sales services and guarantees;
d. The data specified in Article 5, paragraph 3, unless already provided before contract execution;
e. The termination conditions for contracts longer than one year or of indefinite duration. - If Roos Illustraties has committed to delivering a series of products or services, paragraph 5 applies only to the first delivery.
Article 7 – Intellectual Property
- Roos Illustraties retains all intellectual property rights (copyright, patents, trademarks, designs, etc.) on all drawings, texts, quotes, images, and sketches unless agreed otherwise in writing.
- The customer may not copy, distribute, or use the intellectual property rights specified in Article 7, paragraph 1, without prior written permission from Roos Illustraties.
